ARTICLE 1: PURPOSE AND SCOPE
These General Terms and Conditions (T&Cs) govern the use of the vinyaqui.com platform and the booking procedures for wine tourism services.
vinyaqui.com acts as a technical intermediary and matching platform between visitors (hereinafter the "Visitor") and partner wineries (hereinafter the "Host").
Important: vinyaqui.com is not the seller of the tasting service nor the organizer of the event. The service contract is concluded directly between the Visitor and the Host. The role of vinyaqui.com is limited to facilitating booking and secure payment through a third-party provider.
ARTICLE 2: BOOKING PROCESS

Selection: The Visitor selects a service via the Host’s calendar.

Price: Prices are indicated in Euros and include all applicable taxes (TTC). They correspond to the total amount paid by the Visitor.

Participants: The Visitor must specify the number of adults and children. Pricing conditions for minors (free of charge or reduced rate) are freely determined by the Host. If no information is specified, accompaniment is free of charge, without beverage service. Minors must be accompanied by a responsible adult.

Confirmation: The booking becomes final and binding upon full payment of the price and technical validation by the Platform.
ARTICLE 3: SECURE PAYMENT (STRIPE)
Payment is made exclusively online by credit/debit card at the time of booking.
3.1 Technical operation
The Platform uses the secure payment solution Stripe.
By accepting these T&Cs, the Visitor and the Host acknowledge that the financial transaction is managed by Stripe.
3.2 Financial flows
The total order amount paid by the Visitor is processed by Stripe, which automatically distributes the funds as follows:

The portion due to the Host (service price) is credited directly to the Host’s connected Stripe account.

The portion due to vinyaqui.com (service and intermediation commission, including transaction fees) is automatically deducted at the time of the transaction.
Accordingly, vinyaqui.com does not collect the funds intended for the Host into its own bank account, but acts as a business introducer remunerated through a commission on the transaction. The invoice for the main service is deemed to be issued by the Host. vinyaqui.com issues an invoice or summary corresponding only to its service/commission fees to the Host.
ARTICLE 4: CANCELLATION, WITHDRAWAL AND REFUND
4.1 No right of withdrawal
In accordance with Article L.221-28 of the French Consumer Code, the 14-day right of withdrawal does not apply to leisure services (including scheduled tastings) to be provided on a specific date or during a specific period.
4.2 Cancellation and refund policy
In the event of cancellation by the Visitor, the refund is processed via Stripe, according to the following rules:

A. Portion due to the Host (80%): The specific cancellation conditions defined by the Host and displayed on the offer prior to payment shall apply.

B. Portion due to vinyaqui.com (Commission – 20%):

Cancellation more than 7 days before the service date: The platform commission is refunded.

Cancellation 7 days or less before the service date: The commission remains payable to vinyaqui.com as compensation for administrative, booking, and non-refundable bank fees (charged by Stripe).

4.3 Cancellation by the Host
If the Host cancels the service (e.g., bad weather, force majeure, unforeseen circumstances), the Visitor will receive a full refund (100%) via the original payment method.
ARTICLE 5: LIABILITY AND INSURANCE
5.1 Host liability
The Host is solely responsible for the proper performance of the service (welcome, tour, tasting, safety of the premises). As an intermediary, vinyaqui.com cannot be held liable for dissatisfaction regarding wine quality, accidents occurring on the Host’s premises, or schedule changes made by the Host.
5.2 Visitor liability
The Visitor is responsible for their own conduct and that of any minors accompanying them. They agree to comply with the safety instructions provided by the Host. Any material damage caused to the property by the Visitor may result in direct claims or legal action by the Host.
5.3 Alcohol consumption
Excessive alcohol consumption is dangerous to health. The Visitor agrees to consume alcohol responsibly. vinyaqui.com and the Host reserve the right to interrupt the service if a Visitor’s behavior becomes inappropriate or dangerous due to alcohol consumption, without entitlement to a refund.
ARTICLE 6: PROTECTION OF MINORS
The sale of alcohol to minors under 18 years old is strictly prohibited. By accepting these T&Cs, the Visitor certifies that they are over 18 years old. The Host reserves the right to request proof of identity before serving alcohol.
ARTICLE 7: PERSONAL DATA
The data collected (first name, last name, email, phone number) is necessary for processing the booking and is transmitted to the Host partner to enable them to welcome the Visitor. This data is not sold to third parties.
In accordance with the GDPR, the Visitor has the right to access, modify, and delete their personal data upon simple request to contact[at]vinyaqui.com.

ARTICLE 8: APPLICABLE LAW AND MEDIATION
These terms are governed by French law.
In the event of a dispute, the Visitor shall first contact vinyaqui.com in order to seek an amicable resolution.
In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, vinyaqui.com shall provide the consumer with the contact details of the consumer mediation service to which it is affiliated: -
ARTICLE 9: USE OF THE PLATFORM
1. Access to the service
The Platform is accessible free of charge to any Visitor with internet access.
2. User account
To make a booking, the Visitor may be required to create an account. They are responsible for maintaining the confidentiality of their login credentials and agree to provide accurate information.
3. Content and Accuracy of Information
The Host is solely responsible for the information, photos, and availability published on their dedicated page. vinyaqui.com makes reasonable efforts to verify the quality of partner wineries but cannot be held liable if information provided by a Host proves to be inaccurate or incomplete.
4. Suspension and termination
vinyaqui.com reserves the right to suspend or delete, without prior notice or compensation, a Visitor’s access to the Platform in the event of a breach of these T&Cs or fraudulent use.
5. Availability and Maintenance
vinyaqui.com uses reasonable means to ensure high-quality access to the service. However, the Platform is provided "as is". vinyaqui.com does not guarantee uninterrupted availability or the absence of errors (bugs, technical maintenance, network failures).
Article 10 - Gift card terms of use
1. Nature of the gift card
The Viny'aquí gift card is a limited network instrument within the meaning of Article L521-3 of the French Monetary and Financial Code (PSD2 Art. 3(k)(i/ii) transposition). It does not constitute electronic money and may only be used with partner winemakers listed on the Viny'aquí platform, exclusively to pay for wine tourism services.
2. Validity
The gift card (code) expires 6 months after the purchase date. The recipient must redeem the code in their account before that date. After this period, the gift card is permanently lost and cannot be refunded.
3. Refund
The gift card is non-refundable. An exceptional refund may be granted in cases of duly justified force majeure (permanent closure of the provider, medical impediment certified by a doctor, etc.). The decision is made on a case-by-case basis by customer service.
4. Use and activation
- The card is materialised by a unique 16-character code, sent to the buyer or directly to the beneficiary by email.
- To use the card, the beneficiary must create a Viny'aquí account or log in, then enter the code in the "My wallet" section. The balance is then credited to their account and becomes nominative.
- The balance may be used in one or more transactions on any eligible activity. An additional payment by bank card is required if the chosen activity exceeds the available balance.
- The balance cannot be converted into cash.
5. Personal data
The email addresses of the buyer and the beneficiary are processed exclusively for sending and managing the gift card, in accordance with the GDPR and the Viny'aquí privacy policy. No data is transferred to third parties other than the technical providers required (payment, email delivery, hosting).
6. Fraud
Viny'aquí reserves the right to invalidate, without notice or refund, any card whose fraudulent use is established (resold code, illicitly obtained, repeated activation attempts, etc.). Activation attempts are logged for audit purposes.
7. Data retention
Records relating to gift cards and wallet transactions are retained for 10 years for accounting and legal purposes (Article L123-22 of the French Commercial Code).
